Terms & Conditions for Parcel Insurance

“Customer” means the party which has entered into agreement with UNIVAL Logistics (“UNIVAL”).

UNIVAL Logistics Website (“Website”) can be accessed over the internet at www.unival-logistics.com.

Unless otherwise agreed in writing, these Terms & Conditions for Parcel Insurance (“Agreement”) covers shipments of high-value packages which are protected from loss, damage, destruction, theft, mis-delivery, accident, acts of God, strikes, lockouts  during the shipment to or from designated locations. 

Scope of Services

Customer may ship his high-value packages with UNIVAL Logistics, and UNIVAL Logistics will permit the Customer to process and print shipping labels though the Website, enjoy discounted shipping rates, and to declare a value per package to be reimbursed for any loss under the t Terms and c Conditions set forth herein.

For each shipment covered, Customer agrees to pay UNIVAL Logistic’s applicable fees for the particular route, carrier, and shipping method of each package.  Customer agrees that Customer’s choice to include any shipment under UNIVAL Logistic’s coverage shall not be complete and shall not be effective unless the liability is declared on the Website.  If, for any reason, a package is incorrectly declared on the Website, Customer should inform UNIVAL Logistics of the error immediately, preferably no later than midnight in the Time Zone of the place of origin on the date of shipment.  Customer may inform UNIVAL   Logistics  of the correct insurance value via email or fax.  Customer shall have no rights to coverage or reimbursements for any package which is declared after a loss has occurred.

UNIVAL   Logistics’  Parcel Insurance is backed by our policy with Jewelers Specialty Insurance Service (J.S.I.S.) covering “All Risks” subject to the Terms & Conditions and stipulations of the governing insurance policy.

UNIVAL acts as a facilitator to arrange Parcel Insurance and postage label generation on behalf of its Customer.  UNIVAL is not an insurance company and is not affiliated with any insurance company.

General Terms & Conditions

The Customer may use UNIVAL   Logistics’  Website to process and print shipping labels and to ship packages through Federal Express (“FedEx”) using UNIVAL   Logistics  private account.  Such shipping labels include the pre-payment of shipping charges in the carrier’s accounting system, to enable carriage of the package without the Customer making any payment arrangements directly with the carrier.

Customer may also use his own private account with FedEx using UNIVAL   Logistics’  Website to process and print shipping labels.  In this case, Customer will pay carriers directly for shipping labels, but may declare values to UNIVAL  Logistics  for insurance coverage.

Customer agrees that only shipments with one of the following carriers and services can be covered by UNIVAL   Logistics’  Parcel Insurance, whether freight or postage is paid through UNIVAL   Logistics  or directly to the carrier by the Customer:

  • Federal Express (FedEx)
    1. Overnight Air (All Types)
    2. Second Day Air
    3. Ground
    4. International Priority
    5. International Economy
    6. COD (USA recipients only)

The discounted prices that UNIVAL   Logistics  has negotiated for its Customers for freight charges include the condition that late deliveries are ineligible for the service guarantee refunds normally offered by the carrier with standard pricing.  If a guarantee for timely delivery is important to  the Customer, the Customer remains free to use his own account for freight charges.  UNIVAL   Logistics’  Website allows the Customer to either charge shipments directly to the Customer’s own private account with the carrier or to bill freight with UNIVAL   Logistics .

Customer agrees that the Customer, not UNIVAL   Logistics , is responsible for complying   with  all laws and regulations of the countries of origin and destination and any other countries involved as to the contents of the shipment, packaging, labeling, reporting, duties, taxes, fees, right to ship the contents, or any other law or regulation with regard to the shipment.

Any  delay of the package in Customs due to the Customer’s inaccurate preparation of documents or noncompliance with regulations does not constitute a loss reimbursable under UNIVAL   Logistics’  Parcel Insurance, except if Customs actually loses the Customer’s package within the Customs system.

Customer hereby agrees to pay all fees at UNIVAL   Logistics’  prevailing rates, which fees may vary depending on the particular type of shipment, category of commodity shipped, declared value, destinations and origins, carrier, class of services, and other details of the shipment.  UNIVAL   Logistics  will offer the prevailing rate to the Customer at the point of sale.  The Customer is under no obligation to accept coverage for any shipment if the Customer does not agree to pay the fees quoted.  By choosing to proceed and accept the fees displayed, the Customer agrees to pay those fees for said shipment.

The Customer agrees to pay all additional fees as deemed necessary by UNIVAL   Logistics  as a result of, but not limited to, incorrect weight declaration, incorrect address, additional services not requested at time of shipment, remote address, etc.

UNIVAL   Logistics  reserves the right to cancel or suspend the Customer’s account and the right to use the Website if any fees owed to UNIVAL   Logistics  by the Customer remain unpaid after demand or if the Customer commits some other material breach.

Scope of Coverage

UNIVAL’s Parcel Insurance covers shipments as follows:

  • if picked up by UNIVAL   Logistics  personnel, from the time of leaving the Customer’s premises until proof of delivery to the premises of the recipient   ;
  • if not picked up by UNIVAL   Logistics  personnel, coverage begins after courier scan at Customer’s premises or after scan at official carrier location until proof of delivery to the premises of the recipient  ;
  • for shipments that are not departing from Customer’s premises, coverage begins after courier scan at sender’s premises or after scan at official carrier location until proof of delivery to the premises of the recipient  ;

Customer agrees that only shipments from or to approved countries are eligible for coverage and that shipping to or from certain countries may involve higher premiums fees.  Approved countries are itemized in section “Approved Countries for International Shipments” below.  Only if a country is listed is insurance coverage available.

Conditions for Parcel Insurance Coverage

  • If shipments are not picked up by UNIVAL   Logistics  personnel, UNIVAL   Logistics  requires proof that the carrier actually received and accepted the package for shipment.  Without such proof, UNIVAL   Logistics  reserves the right to accept or deny a claim for loss.
  • When packages are picked up by courier, the Customer must insist that the courier scan the package as being received before leaving the sender’s premises.  If the courier is not equipped to scan the package, the Customer must insist that the sender deliver the package to any official carrier location for scanning and shipment.  Authorized dealers of FedEx are not considered as official FedEx facility.
  • UNIVAL   Logistics  and Customer agree that only approved commodities are eligible for coverage.  Categories of approved commodities by country are available on  carriers’ websites.
  • The Customer agrees to provide the correct and complete delivery address of recipient, including suite/apartment number,   etc. if any.
  • The Customer must correctly identify the contents of the shipment by category at the time each shipment is declared.  Customer agrees that for a variety of reasons, including regulations as to items allowed in package shipments on aircraft, Customs declarations, and trade regulations for certain goods, the Customer’s declaration of the contents must be accurate, and UNIVAL   Logistics  reserves the right to deny reimbursement for any claim for   of  any shipment whose contents are not accurately declared by category.
  • Under no circumstances shall either UNIVAL   Logistics  or the insurance carrier assume any liability for the shipment of contraband or unlawful goods, and all such shipments are strictly prohibited.
  • Unless otherwise agreed in writing between UNIVAL   Logistics  and Customer, UNIVAL  Logistics’  liability shall not exceed the replacement value of the item(s) for delivery to the recipient, as declared during shipment.
  • Under no circumstances shall UNIVAL   Logistics  be responsible for values exceeding the maximum coverage limits as itemized in “Limits of Liability Amounts” below unless otherwise agreed in writing between the parties.
  • In the event the actual value should be understated, UNIVAL   Logistics  will be responsible only for payment of loss up to, but not exceeding, the value actually declared during shipment.
  • For all shipments, Customer must require a Signature Confirmation of Delivery, as evidence of delivery to the correct company or individual recipient.  If the Customer marks a package for signature release – that is, the waiver of Signature Confirmation of Delivery – the Customer thereby waives any right to file a claim for that shipment.
  • For COD shipments (USA recipients only), Customer agrees that only merchandise shipment is covered by UNIVAL   Logistics’  Parcel Insurance.  Return COD payment is not eligible for coverage.
  • The air waybill and/or shipper’s label and/or packaging should not include words indicating value unless necessary for Custom’s purposes (e.g., jewelry, diamond, gold, watch, precious, gems, pawnshop, cash, etc.) and should not contain or display a logo or trade mark or any identifying graphics associated with high-value merchandise.
  • No monetary values are to be declared on the air waybill or the packaging for carriage.
  • For all shipments, the Customer agrees to make use of double packaging.  The Customer may use padded packaging as inner layer inside a box or a small box inside a larger box.
  • For all shipments, the Customer agrees to use Tamper Proof Seal  ing  to secure the exterior container (clear packaging tape is acceptable to use).
  • UNIVAL   Logistics  shall bear no liability for any shipment that is improperly packed at the time the Customer tenders the shipment to the carrier.  Improper packaging includes, but   is  not limited to, damaged boxes  , not distinctly and securely sealed, and  /or  illegible labels .

Claims

Claims will be paid in 6 weeks unless there is a need for further investigation or unless the involved parties do not provide necessary documentation for claims settlement.  The start of the claim process for UNIVAL   Logistics’  Parcel Insurance begins right after the Customer receives the claim settlement from the carrier.  Any reimbursement received by Customer from the carrier shall be deducted from the limit of coverage of UNIVAL   Logistics’  Parcel Insurance.  The Customer agrees to inform UNIVAL   Logistics as soon as he receives the claim settlement from the carrier.

Coverage under UNIVAL   Logistics’  Parcel Insurance terminates once a package is signed for by the recipient at its destination or the carrier has otherwise submitted its standard proof of delivery for the class of service employed, unless the shipment has been properly packed and sealed but on delivery shows evidence of tampering or damage to the container, resulting in a breach of the exterior integrity of the container.

UNIVAL   Logistics  and Customer agree that except when in violation of the Customer’s instructions to the carrier, a package signed for by any apparent representative of the correct company or individual (e.g., receptionist, front desk clerk, residential occupant, security guard) at the correct delivery address shall be deemed delivered.

In the event of loss or damage, UNIVAL   Logistics  shall be notified by the Customer within five (5) days after discovery of any loss or damage and UNIVAL   Logistics  must receive the completed  Claim Form no more than fourteen (14) days from delivery date or date that package should have been delivered.  Without such notifications, UNIVAL   Logistics  reserves the right to accept or deny a claim for loss.

In the event of a loss, the Customer agrees fully to cooperate with UNIVAL   Logistics  and/or insurance company’s adjuster in the course of the investigation.  UNIVAL   Logistics  may request the Customer to submit documents and/or video coverage, as necessary .

If UNIVAL   Logistics  reimburses the Customer for a loss, UNIVAL   Logistics  reserves  the right to obtain all or part   change to “part or all”  of the contents of the shipment if   they are eventually recovered.  If the contents of the shipment are returned to the Customer, the Customer agrees to notify UNIVAL   Logistics  within five (5) days of the recovery.

UNIVAL   Logistics  shall have no liability if Customer intentionally conceals or misrepresents any material fact or circumstance before or after a loss.  Under no circumstance shall either UNIVAL   Logistics  or the insurance carrier assume any liability for any false or fraudulent claims.  Furthermore, any fraudulent claims may make Customer and/or recipient liable for prosecution under applicable civil and criminal regulations in the country of origin and destination.

Warranties of Customer

Customer expressly agrees, represents and warrants as follows:

  • By declaring a shipment to UNIVAL   Logistics , Customer warrants that the Customer or its clients is the owner of the shipped merchandise, is the seller of the merchandise, is returning to its owner, or is otherwise authorized to transport the merchandise.
  • By declaring a shipment to UNIVAL   Logistics  for coverage, Customer warrants that the shipment is in compliance with all foreign, federal, state, and local laws, including export regulations and Customs regulations, and that no controlled substances or illicit contraband is being shipped.
  • The person agreeing to this agreement warrants that he/she is authorized to agree to all of these terms and conditions on behalf of the Customer and all other persons who may be interested in the shipment.
  • The Customer expressly warrants the accuracy of all shipping information provided.
  • The Customer warrants that all shipments are adequately prepared, packaged, and sealed.

Exclusions of Liability

  • Customer agrees that UNIVAL   Logistics’  Parcel Insurance shall not be liable for losses from fraudulent or criminal acts of Customer,   or  the Customer’s employees or agents.
  • Customer agrees UNIVAL   Logistics’  Parcel Insurance shall not be liable for loss or damage by the theft or dishonesty or deception committed by Customer,   or  the Customer’s employees or agents, traveler or messenger in the exclusive employment of the Customer.
  • Customer agrees that no claim for loss or damage shall be valid in the absence of objective physical evidence of tampering with the package or objective evidence of penetration or invasion of the shipping container.  This warranty does not apply to disappearances  of the entire shipped package in transit.

Miscellaneous

  • Any waiver or variation from any term or condition of UNIVAL   Logistics’  Parcel Insurance shall not be interpreted as a modification of this Terms & Conditions nor as a permanent or continuing waiver.
  • If UNIVAL   Logistics  and/or insurance carrier ever elects to honor a claim for  a  loss that might not strictly conform to all of the terms and conditions, this shall never be interpreted as creating any right for reimbursement for any other such non-conforming claims for loss in the future, but shall be treated as a voluntary payment for the purposes of goodwill, marketing, or the like.
  • The Customer agrees that account with UNIVAL   Logistics  may be terminated without cause by either party upon fifteen (15) business days’ prior written notice, or immediately in the case of the Customer’s fraud or fraudulent acts, and non-payment of fees due.  However, termination shall not affect coverage of any package declared prior to the termination if otherwise in compliance with all other terms and conditions.

Limits of Liability Amounts

Limits of liability assumed for reimbursement to the Customer for losses are the following (below shows maximum values that may be declared by the Customer for each shipment):

Notwithstanding the above limits, for all shipments sent Thursday-for-Monday delivery, sent Friday-for-Monday delivery or sent Saturday-for-Monday delivery, UNIVAL   Logistics’  Parcel Insurance liability shall not exceed the following limits:
